Recent Cases

Robbery

Facts: Client charged with armed robbery. Client accused of being the shooter of a pellet gun while 2nd male stole complainant's bike. Client identified by complainant in photo lineup which was done 4 months after the incident.
Verdict: Not guilty
Reasons: Complainant's identification not reliable. Complainant admitted on cross-examination that he told the 911 operator that the shooter was someone else. Complainant also admitted that he provided a description of the shooter to the police that did not fit client's profile. And, judge found that the photo line-up identification was unreliable because too vague.

Criminal Negligence

Facts: Client charged with criminal negligence and assault causing bodily harm.  Client accused of neglecting her child and/or causing injury to the child after unexplained serious bruising was discovered on the child’s body.
Outcome: All charges withdrawn after preliminary inquiry
Reasons: The prosecution realized it had no reasonable prospect of conviction after the Preliminary Inquiry revealed client had taken proper measures to care for the child once the injuries were discovered. No evidence client caused the injuries.

Drug Offences

Facts: Client charged with possession for the purpose of trafficking (PPT) cocaine, marihuana, and codeine. Police followed client's car from known drug trafficker's residence to a service station. Unmarked police cars cornered client's vehicle. Client panicked and put car in reverse, striking police cars. Client and passenger arrested. Small quantities of drugs found in vehicle and on occupants. At trial, Crown Prosecution tried to prove quantities of drugs were consistent with drug trafficking. Defence called its own expert to counter the Crown's expert.
Outcome: Crown offered to resolve the matter with possession charges and fines instead of PPT and jail.
