Recent Cases

Robbery

Facts: Client charged with armed robbery. Client accused of being the shooter of a pellet gun while 2nd male stole Complainant's bike. Client identified by Complainant in photo lineup which was done 4 months after the incident.
Verdict: Not guilty
Reasons: Complainant's identification not reliable. Complainant admitted on cross-examination that he told the 911 operator that the shooter was someone else. Complainant also admitted that he provided a description of the shooter to the police that did not fit Client's profile. And, judge found that the photo line-up identification was unreliable because too vague.

Driving Under the Influence

Facts: Client charged with a DUI. Client left hotel room after getting in a heated argument with a male friend. Male called police to say Client was severely intoxicated and planning to drive home. Police responded. When they arrived, Client was seated in her car with engine running. Police arrested her for having care and control of a vehicle while under the influence of alcohol.
Verdict: Not guilty
Reasons: Although Client was clearly intoxicated, she had a legitimate defence. She was frightened and feared for her personal safety because male had made unwanted sexual advances and was being physically aggressive. She felt she had no other option but to flee from the scene. Judge accepted the Defence of Necessity.

Drug Offences

Facts: Client charged with possession for the purpose of trafficking cocaine. Police stormed a convenience store that Client had entered. Police arrested Client on suspicion of drug trafficking. Small amount of cocaine found on Client. Meanwhile, Police conducted a raid on a hotel room where suspected drug dealers were holed up. Crown alleged that police surveillance put Client going in and out of the hotel room on several occasions prior to the raid.
Verdict: Not guilty
Reasons: Crown was not able to prove Client was anything more than a purchaser of drugs for his own personal use.
